In his track record he boasts of being the first lawyer in Spain to sue -and finally win- for the capital lost in the world famous case of investments managed by Bernard Madoff, the famous financial guru and the biggest pyramid fraudster in history, when 64,800 million dollars worth of money disappeared worldwide..
In Spain, Rafael Reyes claimed from Banco Santander a significant amount of capital invested -and lost in its entirety- by his client, which Banco Santander had left under Madoff's management. After losing at first and second instance, the case was brought before the Supreme Court, which decided to meet in plenary session to resolve the matter.
The case ended up being resolved in favor of the legal direction of Rafael Reyes before the Plenary of the Supreme Court with Ruling No. 254/2015 of January 12, 2015. With this judgment, which fully upholds the appeal of Rafael Reyes, the Plenary of the Supreme Court modifies multiple aspects of the Spanish case law regarding the expiration of the nullity action, the legal standing of marketing banks, the assessment of the testimonies of bank employees and, in short, modifies much of the existing jurisprudence in 2015 on the nullity of financial contracts, thus expanding the judicial protection of bank customers.
Likewise, in parallel to the Madoff case, Rafael Reyes was the first lawyer in Spain to obtain the firm nullity of the then very famous Valores Santander, the largest bond issue in Spain, amounting to 7,000 million euros, made by Banco Santander. Ruling No. 30/2013 of the Provincial Court of Tenerife of January 24, 2013 was a legal milestone because not only did the lawyer managed for the first time that in a single ruling 6 bank contracts were annulled for the same client, but among those six annulled contracts were the Valores Santander bonds, which had never before been judicially annulled despite the multiple rulings previously handed down in the Courts throughout Spain.

Cristina Santana
